Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using TargetVid (“the Service”), you agree to be bound by these Terms of Service (“Terms”). The Service is owned and operated by Blue Snow Developers LLC, a California limited liability company (“Company,” “we,” “us,” or “our”).

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms. If you do not have such authority, or if you do not agree to these Terms, you must not use the Service.

These Terms constitute the entire agreement between you and the Company regarding your use of the Service. Any prior or contemporaneous agreements, communications, or understandings, whether oral or written, are superseded by these Terms.

2. Definitions

• “Service” means the TargetVid platform available at targetvid.com, including all web applications, APIs, video rendering engine, data enrichment services, and share pages.
• “User Content” means any photos, listing data, branding assets, agent information, or other materials you upload to or input into the Service.
• “Generated Content” means videos, share pages, and other outputs produced by the Service from your User Content.
• “Subscription” means a paid plan providing access to premium features and increased usage limits.
• “Data Scenes” means video segments that visualize third-party data (walk scores, school ratings, market trends, climate data, commute times, mortgage rates, and neighborhood amenities).

3. Account Terms

• You must provide accurate, complete, and current information when creating an account.
• You may register using email and password or Google OAuth. You are responsible for maintaining the security of your authentication credentials.
• You must notify us immediately at security@targetvid.com upon becoming aware of any unauthorized access to your account.
• One natural person or legal entity per account. Accounts may not be shared across multiple individuals unless on a Team plan.
• You must be at least 18 years of age to create an account and use the Service.
• You are responsible for all activity that occurs under your account, whether or not you authorized such activity.

4. Service Description

TargetVid is a compositive video engine that generates cinematic videos from real property data, photos, and verified public data sources. The Service includes:

• AI-powered photo analysis (room classification via CLIP vision models, depth estimation via Depth Anything V2)
• Automated video composition with data-driven scene selection
• Data enrichment from public APIs (Walk Score, school ratings, market data, climate, amenities, commute times, mortgage rates)
• Text-to-speech narration with word-level caption synchronization
• 16:9 widescreen video rendering (portrait and square formats are on the roadmap, not yet available)
• Branded share pages for video distribution
• Custom branding (colors, fonts, logos, themes)

Videos are composed deterministically: the same inputs, data, and configuration will produce the same output. All data visualized in videos comes from verified public sources, not generative AI.

5. URL Imports & Source Photos

Our URL import feature lets you generate a video from a public real-estate listing page (e.g., Redfin or Realtor.com). You agree that:

1. You will only import listings you represent as the listing agent, listings you have written permission from the listing agent to market, or listings you are using solely for your own private preview and will not share publicly.
2. Photos retrieved by the URL import are owned by the listing brokerage, photographer, or other rights holders. We do not grant you any license to those photos beyond the limited use described in (a). You are responsible for clearing usage rights before sharing any video that includes URL-imported photos.
3. We retain a temporary copy of the source photos for up to 30 days to power your render, then delete them. The rendered video output is yours to keep and re-render.
4. We respond to DMCA takedown notices within 10 business days. Our DMCA agent is listed at /dmca. If a rights holder requests removal of a render that includes their photos, we will honor the request, remove the render, and notify you.
5. URL imports do not constitute MLS-licensed access. For MLS-grade reliability, accuracy, and broad listing coverage, see the Teams plan (MLS integration on the roadmap, 2026 H2).
6. If a third party brings a claim against us arising from your use of URL-imported photos in violation of (a)–(c), you agree to indemnify and hold us harmless to the extent permitted by law.

Zillow imports are not supported. We do not bypass technical access controls; if a site returns a non-200 response, the import will fail cleanly and you can upload photos directly instead.

6. Photos Containing Identifiable Individuals

If photos you upload or import contain identifiable individuals (including children, current occupants, staging models, or third parties), you confirm you have the appropriate consents to use those photos in marketing materials. We do not perform facial recognition, identity tagging, or biometric analysis on uploaded media.

7. API Usage

If you access the Service through our API (when available), the following additional terms apply:

• API access is subject to rate limits based on your subscription plan. Exceeding rate limits may result in temporary throttling.
• API keys are confidential. You must not share, publish, or embed API keys in client-side code, public repositories, or any publicly accessible location.
• Automated bulk access outside of published API endpoints is prohibited.
• We reserve the right to modify API endpoints, parameters, and response formats with reasonable notice.
• You must not use the API to build a competing service or to systematically extract platform data.

8. Acceptable Use

You agree not to:

• Upload content you do not have the legal right to use, including copyrighted photos you did not take or license.
• Generate videos for properties you are not authorized to represent or market.
• Use the Service to create misleading, fraudulent, or deceptive content, including misrepresenting property features, prices, or availability.
• Attempt to reverse-engineer, decompile, disassemble, or derive the source code of any portion of the Service, including the video rendering pipeline, AI models, or data enrichment systems.
• Circumvent or attempt to circumvent usage limits, authentication mechanisms, or access controls.
• Resell, sublicense, or redistribute access to the Service without prior written permission from the Company.
• Introduce malware, viruses, or any other harmful code into the Service.
• Use the Service in violation of any applicable local, state, national, or international law, including real estate advertising regulations (Fair Housing Act, Truth in Advertising).
• Scrape, crawl, or otherwise programmatically extract content from the Service outside of authorized API usage.
• Use the Service to store or transmit personal data in violation of data protection regulations.

We reserve the right to suspend or terminate accounts that violate these restrictions, with or without prior notice, depending on the severity of the violation.

9. Intellectual Property

Your Content: You retain full ownership of all User Content you upload to the Service. By uploading content, you grant us a limited, non-exclusive, royalty-free license to process, store, transform, and render it into videos solely as part of providing the Service. This license terminates when you delete your content or your account.

Generated Videos: Videos generated by the Service are owned by you. You may use, distribute, publish, and commercially exploit Generated Content without restriction, subject to any third-party content licenses that may apply (e.g., music tracks used under Creative Commons licenses).

Platform IP: The TargetVid platform, including its software, algorithms, machine learning models, design system, video templates, data visualization components, and branding, is the intellectual property of Blue Snow Developers LLC. Your subscription grants you a limited, revocable license to use the Service, not ownership of any platform component.

Feedback: If you provide suggestions, ideas, or feedback about the Service, you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.

10. Data Processing

When you use the Service, the following data processing activities occur:

• Photo analysis: Uploaded photos are processed server-side through on-platform AI models (CLIP for room classification, Depth Anything V2 for depth estimation). Photos are never sent to third-party AI services.
• Address geocoding: Property addresses are sent to Nominatim (OpenStreetMap) to obtain geographic coordinates, which are then used to query public data APIs.
• Data enrichment: Geographic coordinates are sent to Walk Score, FRED (Federal Reserve), NCES (school data), Open-Meteo, OSM Overpass, Redfin, Google Distance Matrix, and Mapbox to enrich videos with neighborhood data.
• Voice generation: Narration scripts are generated deterministically from templates and processed through text-to-speech on our servers. Audio never leaves our infrastructure.
• Video storage: Rendered videos and photos are stored on Cloudflare R2 (encrypted at rest). Videos remain stored until you delete them or your account is terminated.

11. Third-Party Data

Videos may include data sourced from third-party providers including Walk Score, school rating databases, Federal Reserve Economic Data, Open-Meteo climate data, OpenStreetMap, Redfin market data, Google Maps commute data, and Mapbox maps.

While we source data from reputable public APIs, we do not warrant the accuracy, completeness, timeliness, or reliability of any third-party data. Data may be cached for performance and may not reflect the most current information.

You are solely responsible for verifying the accuracy of all data before using generated videos in marketing materials, MLS listings, or any other professional context. The Company is not liable for any errors, omissions, or inaccuracies in third-party data displayed in your videos.

12. Payment Terms

Paid subscriptions are billed monthly through Stripe, our payment processor. By subscribing to a paid plan, you authorize recurring charges to your payment method on file.

• Billing cycle: Subscriptions renew automatically on the monthly anniversary of your initial subscription date.
• Price changes: We will notify you at least 30 days before any price increase. Your continued use after the effective date constitutes acceptance of the new price.
• Failed payments:If a payment fails, we will attempt to charge your payment method again per Stripe's retry schedule. If payment cannot be collected after multiple attempts, your subscription may be downgraded to the Free plan.
• Taxes: Prices are exclusive of applicable taxes. You are responsible for any sales tax, VAT, or similar taxes imposed by your jurisdiction.

We do not store credit card numbers. All payment data is handled directly by Stripe in accordance with PCI-DSS requirements. See Stripe's Privacy Policy for details.

13. Cancellation & Refunds

Cancellation: You may cancel your subscription at any time through the Stripe Customer Portal accessible from your dashboard. Cancellation takes effect at the end of the current billing period. You retain access to paid features until your current period expires.

Downgrade: Upon cancellation, your account reverts to the Free plan. Videos previously generated and stored remain accessible, but new video generation is subject to Free plan limits.

Refunds: Refunds are handled on a case-by-case basis. To request a refund, contact support@targetvid.com within 14 days of the charge. We generally grant refunds when:

• A critical service outage prevented you from using the Service during the period.
• You were charged erroneously (e.g., after cancelling before the renewal date).
• You are a first-time subscriber and are unsatisfied within the first 7 days.

Account deletion: You may request deletion of your account and all associated data by contacting privacy@targetvid.com. Account deletion is permanent and irreversible. All data, including videos, photos, listings, and branding assets, will be permanently deleted within 30 days.

14. Service Availability

We strive to maintain high availability (99.9% uptime target) but do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we aim to provide 24 hours advance notice)
• Emergency security patches or critical bug fixes
• Third-party service outages (Supabase, Stripe, Cloudflare, Vercel)
• Circumstances beyond our reasonable control (force majeure)

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BLUE SNOW DEVELOPERS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM OR RELATED TO:

• Your use of or inability to use the Service
• Inaccuracies in third-party data displayed in generated videos
• Unauthorized access to or alteration of your data
• Any content or conduct of any third party on the Service
• Service interruptions, errors, or data loss

OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Blue Snow Developers LLC, its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; (d) any User Content you upload or submit through the Service; or (e) your violation of any applicable law or regulation.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in California. You consent to the personal jurisdiction and venue of such courts and waive any objection to inconvenient forum.

Severability: If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.

18. Changes to Terms

We may modify these Terms at any time. For material changes, we will provide at least 30 days advance notice via:

• Email notification to the address associated with your account
• A prominent notice within the Service dashboard
• An updated “Last updated” date at the top of this page

Continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and may request account deletion.
